The dramatic visit of PP Pandey in a ICU ambulance apparently earned Mr Pandey another 40 hours of relief against any arrest. Of course it was not his doctors who gave the relief but his lawyer Mr Nirupam Nanavati succeeded in persuading the Special CBI Court No. 2 to grant a bail for a limited period of 40 hours. The period ends on 31st July 2013 at 10:45 a.m. Also, while declaring him as a proclaimed absconder, Mr Pandey was given time to surrender on or before 31st of July 2013.
We do not quite know what would be the next strategy of Mr PP Pandey, but he certainly doesn’t have too much time to play with. Would he try another gimmick of getting admitted to yet another hospital or would the CBI Magistrate take him into judicial custody or will the limited order of anticipatory bail be challenged before a higher forum? A lesson that we have to learn from this PP Pandey episode of the last 3 months is that the provision of a criminal procedure is too generous towards an accused who can afford a battery of eminent criminal lawyers.
